1. Scope of Application
 
1.1. The business relationship between Hondawatch and the customer will be governed exclusively by the Terms and Conditions in effect at the time of ordering. Customer terms and conditions that differ in whole or in part from these Terms and Conditions shall not apply unless expressly agreed in writing by Hondawatch.
 
2. Sales Contract Signing
 
2.1. All offers made by Hondawatch are non-binding and subject to change. They are intended solely to inform customers who are required to make a legally binding offer.
 
2.2 All watches offered by Hondawatch are guaranteed to be genuine and in the condition as accurately described in the product description. Each product description is written specifically for each item and therefore reflects the actual condition of the item as accurately as possible.
 
2.3 Descriptions may include detailed, high-resolution photographs of the item taken by Hondawatch. All photographs are taken by Hondawatch and comply with copyright laws. All photographs are provided in their original, unedited state. Only color balance, saturation, brightness, contrast, and focus are adjusted.
 
2.4 Unless otherwise specified, the product will not be delivered with original papers, box, or packaging, but Hondawatch will deliver the product in a neutral box with the warranty card, Terms and Conditions, and invoice.
 
2.5 Any defects in the product sold that are clearly visible in the photos but not mentioned in the description text are considered “as described”. All watches offered for sale have been repaired, serviced, and adjusted, unless otherwise specified in the description.
 
2.6. A customer order is an offer submitted to Hondawatch for the conclusion of a sales contract. In the case of online orders, the customer places a binding order by clicking the “order with obligation to pay” button. The contract is only concluded when Hondawatch expressly accepts the offer. Acceptance is subject to the availability of the purchased product.
 
2.7. If Hondawatch discovers during order processing that the ordered watch is no longer available, the customer will be notified via email.
 
2.8. Hondawatch will confirm the customer’s order via email. This email (order confirmation) will list the order details and payment method. Order confirmation represents acceptance of the offer, thus forming a sales contract. The content of the sales contract is based on the content of the order confirmation and these Terms and Conditions.
 
3. Pricing and Payment Terms
 
3.1. All prices are final prices in USD. Hondawatch notes that the sale of used goods under contract is subject to different tax rates as per § 25a UStG and does not include VAT. Therefore, the invoice will not show separate VAT.
 
3.2. Prices may be adjusted (reduced) based on prior agreement between Hondawatch and the customer. The discounted price only applies if both parties have explicitly agreed on the price in writing.
 
3.3. Ordered goods will only be shipped after the customer has paid the full purchase price.
 
5. Shipping, Shipping Costs, and Risk Transfer
 
5.1. Goods will be shipped the next business day after payment is received.
 
5.2. For security reasons, goods are only shipped on weekdays, Monday through Friday.
 
5.3. All shipments are fully insured and carefully packaged. Hondawatch will ship ordered goods using different shipping companies depending on the country.
 
5.4 If the customer is a consumer, they have the right to cancel the contract. Please see the relevant instructions in section 7.
 
5.5 The customer is responsible for customs fees, VAT, or any other import charges in the event of shipping to a country outside the US. Hondawatch is not responsible for any delays in shipment due to import procedures and cannot pay or refund import fees or other related payments.
 
6. Damage During Transportation
 
Customers must immediately report any damage that may occur during transportation to the shipping company. In case of a claim, the customer must accurately describe the fault and notify Hondawatch in writing no later than 3 days from the date of receipt of the goods.
 
7. Right to Cancel the Contract
 
7.1 You have the right to cancel this contract within fourteen days without giving a reason. Fourteen days is calculated from the date you or a third party authorized by you, but not the shipping company, receive the goods. To exercise the right to withdraw from the contract, you must clearly notify us of your decision to withdraw from this contract (e.g., by letter or email).

7.2 If you withdraw from this contract, we must refund you all payments received from you, no later than fourteen days from the date we receive your notice of withdrawal. Currency fluctuations and exchange rate fees between the time of purchase and the time of return are at the buyer’s risk.
 
7.3 Hondawatch reserves the right to withhold the refund until we receive the goods.
 
7.4 Hondawatch will use the same payment method you used for the original transaction to process the refund, unless otherwise agreed.
 
7.5 Hondawatch will retrieve the goods at its own expense via DHL Express or FedEx.
 
7.6 You are only liable for potential loss of value of the goods if such loss is due to your handling of the item in a manner unnecessary to check the condition, characteristics, and functionality of the watch.
 
7.7 The customer must return all documents and packaging, as well as any items included in the shipment of the purchased item.
 
8. Warranty, Liability, and Compensation for Damages
 
8.1. If the customer is a business, liability for defects in used goods is excluded.
 
8.2. If the customer is a consumer, claims for compensation for damages due to defects are excluded. Remaining warranty rights are limited to one year for used products.
 
8.3. The warranty excludes issues related to the watch’s accuracy, water resistance (both from water and sweat), strap wear and tear (scratches on the case, crystal, strap, unprotected gemstones or other ornaments), as well as broken/missing crystal, crown, spring, buttons and levers; damage from drops/impacts, or from dirt or moisture on the watch is also not covered.
 
8.4. Hondawatch is not responsible for defects caused by improper use of the product by the buyer or a third party. The same applies to normal wear and tear.
 
8.5. Removing labels, stamps or other markings necessary for product identification will result in the loss of the warranty.
 
8.6. The warranty expires immediately upon the customer or a third party attempting to repair the watch themselves. In such cases, no repair or maintenance costs will be reimbursed.
 
8.7. Potential liability exclusion clauses do not apply to willful acts or gross negligence of Hondawatch and its dealers, nor to injuries to the life or health of the customer, nor to misjudgments of contractual obligations of Hondawatch or its dealers, and ultimately do not relate to the guaranteed features.
 
8.8 Any costs or losses incurred by the customer as a result of the use of the provided watch
 
9. Purchase Risk
 
Hondawatch assumes no purchase risk and may withdraw from the contract if Hondawatch fails to receive the goods as contracted from the supplier or manufacturer due to no fault of its own (intentional or negligent).
 
10. Offset and Retention Rights
 
10.1. The Customer may only offset counterclaims that Hondawatch does not dispute or that have been awarded by a court without further appeal.
 
10.2. The Customer may only exercise the right to retain the extent of their counterclaim based on the same contractual relationship.
 
11. Identity Verification for Transactions Over USD 15,000
 
11.1. To fulfill Hondawatch’s obligations under German Anti-Money Laundering Law, cash deposits exceeding US$15,000 will only be accepted or paid after prior verification of the customer’s identity according to the following terms:
 
11.2. If the customer is an individual, identity verification requires the presentation of a government-issued photo ID (ID card or passport).
 
11.3. If the customer is a legal entity, Hondawatch requires a copy of the business register or equivalent public register, incorporation documents or equivalent proof of access to such register or list.
 
12. Privacy
 
Hondawatch complies with the provisions of the German Federal Data Protection Act and refers to its privacy policy, which you can read at http://www.hondawatch.com. Personal data is collected only to the extent that it is technologically necessary, for example, to fulfill the contract. The collected data will not be sold or transferred in any form to third parties unless it is absolutely necessary to fulfill the contract. Hondawatch only collects, processes, and uses personal data without further consent to the extent necessary to fulfill the contract or to generate invoices. Upon customer request, Hondawatch will provide information about stored personal data. This information will be provided in written form (letter or email).
 
13. Copyright
 
13.1 All text displayed on the website http://www.hondawatch.com and all descriptions, images, and graphics, as well as the website layout, are the exclusive intellectual property of hondawatch.com. Any copying or use without prior written permission from Hondawatch is strictly prohibited.
 
13.2 Hondawatch is not an official dealer of any watch manufacturer. Hondawatch has no affiliation with any watch manufacturer. All trademarks, names, and designs are the property of their respective owners.
 
14. Applicable Law, Jurisdiction
 
14.1 If the client is a business person, public organization, or separate legal entity under public law without a place of residence in the country, the courts in Rostock have exclusive jurisdiction over all disputes arising directly or indirectly from the contractual relationship.
